DUI Means Vehicle Search

In some circumstances if a law enforcement officers have a reason to suspect the presence of drugs in a vehicle (probable cause), they have a right to conduct a vehicle search without obtaining a search warrant. If you are investigated for DUI, however, you can expect that your car is going to be searched by either:

• Reasonable Suspicion
• Inventory Search

Investigation of a DUI suspect for being under the influence of marijuana often stems or leads to the search of a vehicle whether based on probable cause. Regardless of whether probable cause exists however, an arrest for DUI will always lead to an Inventory Search. This warrantless search is legal and may be conducted inside the trunk, inside the glove box, and even in the closed containers found in the vehicle.
